Terms of Service

The working agreement that keeps our collaborations clear, fair, and professional.

Last updated: September 2026

1. Agreement & Scope

These Terms of Service ("Terms") govern the relationship between Make//Next ("we", "us") and any client ("you") who engages us for web or mobile development services. By submitting a project enquiry, accepting a quote, or commissioning work, you agree to be bound by these Terms.

2. Project Estimates & Quotes

All quotes provided by Make//Next are estimates based on the information you share at the time of enquiry. The final scope, timeline, and price are confirmed in a written agreement before work begins. Any changes requested after kickoff may affect cost and delivery dates.

3. Client Responsibilities

You agree to provide accurate information, timely feedback, and any required assets (logos, copy, credentials, hosting access) promptly. Delays in providing materials may extend the agreed timeline. You confirm that all content supplied to us is legally owned or licensed for use in your project.

4. Payment Terms

For most projects, payment follows a milestone structure: an upfront deposit to begin work, with the balance due upon delivery. Specific milestones are defined in your individual agreement. Work does not commence until the deposit is received, and final deliverables are released after the final balance is cleared.

5. Revisions & Approvals

Each project includes a defined number of revision rounds, specified in your agreement. Additional revisions beyond the included scope are billed separately. Once you approve a milestone or final delivery, re-opening previously approved work may incur additional charges.

6. Delivery Timeline

We commit to reasonable delivery timelines based on project scope. Timelines are estimates and depend on timely client input. We are not liable for delays caused by late feedback, scope changes, or third-party dependencies (hosting, app store approvals, payment gateways).

7. Intellectual Property

Upon receipt of full payment, ownership of the final deliverables transfers to you. However, we retain the right to display the completed work in our portfolio and marketing materials unless a non-disclosure agreement explicitly prohibits it. Third-party assets, fonts, and plugins remain subject to their respective licenses.

8. Confidentiality

We treat all client information as confidential. We do not share your business data, credentials, or project details with third parties without your consent, except as required by law or to deliver the agreed services.

9. Warranties & Limitations

We warrant that delivered work will be free from material defects for a period of 30 days following final delivery. We are not responsible for issues arising from client modifications, third-party service changes, or environments outside our control. Our liability is limited to the amount paid for the specific project in question.

10. Refund Policy

The upfront deposit covers project initiation and is non-refundable once work has commenced. If a project is cancelled mid-way, you are billed for work completed up to the cancellation date. Refunds, where applicable, are assessed on a case-by-case basis.

11. Maintenance & Support

Ongoing maintenance and support are provided under a separate agreement if required. Standard project delivery does not include free updates, bug fixes, or feature additions beyond the agreed scope, unless explicitly stated in writing.

12. Termination

Either party may terminate the engagement with written notice. Upon termination, you are liable for all work completed and costs incurred up to the termination date. We will hand over any completed work for which payment has been received.

13. Changes to These Terms

We may update these Terms from time to time. The current version is always available on this page. Continued engagement of our services after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the applicable laws of India. Any disputes will be resolved through good-faith negotiation first, and if unresolved, through the appropriate legal channels.
